Waiver Of Liability:

By making a payment, the client agrees to exempt, release, and hold harmless 10395781 Canada Inc. (“Company”) and its operating businesses from any claims, actions, suits, costs, damages or liabilities including but not limited to liability for personal injury that may occur of any person at the event, property damage and/or wrongful death, including if caused by negligence on the part of the Company, its employees, owners, agents, or contractors. 10395781 Canada Inc. will set up the rental item(s) at the client’s venue. The customer is responsible for ensuring the decor is monitored from the start of setup to the completion of the event to prevent any damage to property including floors, walls, equipment or others.

The customer is responsible for any property damage caused by rented items during setup or thereafter and agrees to hold harmless 10395781 Canada Inc., its employees, owners, agents, or contractors from any liabilities. Additionally, any negligence by any guest or individual whatsoever at the venue after the rental item(s) is set up is the sole responsibility of the customer. It is the responsibility of the customer to make sure that all individuals at the establishment take precautions near our item(s). The customer agrees to be held financially responsible for the loss or damage of the items rented and will pay for the cost of replacement or repair in addition to any third-party claim that may arise regarding the items rented or venue.

Deposits & Payments:

All payments are non-refundable. Deposits are required to secure a booking. The remaining balance is due in full at least 7 days before the event date otherwise, we cannot guarantee the event can be fulfilled and a change order fee will be charged.

Outdoor Events:

If the weather has conditions of rain or winds, the decor cannot be set up outside. We can set up indoors.

Change Orders:

Change orders for any reason (removal of items, change of dates, late payment, etc) are subject to a change order fee of $50+HST. If a new date is provided by the customer, we will review it to determine if we have availability. Payments made related to cancelled events will be kept by the Company as credit for 12 months to apply to a future event. If the customer does not provide a new event date that is to occur within 12 months from the original event date, then the payment is forfeited by the Customer and considered earned by the Company. Notice of cancellation in writing by email must be provided by the Customer to the Company at least 48 hours before the event for it to be applied as a credit towards a future event. Our staff will send a questionnaire by email requesting event info (location, arrival time, pickup time, contact info, etc.). If the questionnaire is not fully completed at least 7 days before the event start time, we cannot service the event due to scheduling constraints. A change order fee will be issued for $50+HST for a rescheduled event.

Setup Location:

Items rented must be placed as close as possible against a wall, on a flat surface, dry area, and not moved during an event. If the customer takes the risk of having items placed outside, they are responsible for ensuring weights are placed on the base to ensure it doesn’t fall over and are kept away from the rain. Marquee letters with lights require electricity and must be placed close to an outlet. We do not provide generators. To prepare balloon decor, we must be provided with an outlet to plug in an electric pump. Balloons will pop if they are set up outdoors due to heat or rough surfaces. We cannot be held responsible for balloons popping and will not make a second trip back to the event location to make modifications.

Setup Time:

Please allow for a 3 hours window for setup prior to your event start. We will arrive during this window to perform the decor setup. Event rentals are for same-day rental/pickup. Photo booth electronic images are deleted after 6 months. Customers must download before to keep copies.
